Lyman submits motion for expedited preliminary injunction to prevent printing of ballots until Utah Supreme Court rules on contested election
SALT LAKE CITY — GOP convention nominee for governor Phil Lyman has submitted a motion for an expedited preliminary injunction and briefing schedule to prevent the printing of ballots until the Utah Supreme Court has ruled on his petition contesting the June 25th primary election. The preliminary injunction alleges that Lt Governor Henderson has committed a third degree felony and malfeasance in office for creating a counterfeit ballot. The ballot was counterfeit because the primary for governor, as well as a handful of other races including US Senate, was illegitimate per Lyman’s petition to the Utah Supreme Court on August 2, 2024. According to Utah Code 20A-4-402 and 20A-4-501, election results can be set aside if there was improper conduct that would change the outcome of the election for that office. Since Lyman won the GOP convention with 67.5% of delegate votes to Spencer Cox’s 32.5%, per previous court rulings on SB54, Lyman has earned a general election nomination as the Republican candidate and no primary election was required in that race, regardless of signatures collected by other candidates.
“It is our duty as elected officials that we have free and fair elections in Utah,” Lyman said. “We owe it to the public to ensure that elections are conducted lawfully and candidates are treated fairly. As Republicans, we also need to defend our party’s right to nominate candidates via our party’s constitution and bylaws, which state the winner of the convention is the GOP nominee for the general election.”
